课程介绍 婚姻家庭热点问题解析 课程中文简介
本课程拟分专题讲授的形式，融入法学、社会学、伦理学、心理学等知识，让学生了解世界范围内婚姻家庭存在的共同问题，包括事实婚姻、非婚同居、有配偶者与他人同居给婚姻立法带来的新问题，同性恋与同性婚对各国传统婚姻家庭的新挑战，各国在禁止和消除家庭暴力方面的努力，婚检制度改革与实践中遭遇的尴尬、无效婚姻制度在立法上的变迁，第三者、亲子鉴定和代孕等婚姻家庭伦理道德问题，也包括我国最高人民法院关于婚姻法的司法解释引发房产更名热的问题，婚前财产、婚后夫妻共同财产的相关规定出台的背景、立法的精神实质解读等，分析在离婚率日益攀升的今天，婚姻家庭到底面临了哪些新问题？上述热点问题的分析与探讨，旨在对学生倡导一种得到社会公众普遍认可的婚恋观，直面婚姻家庭可能会出现的困惑，学会依法解决遇到的婚姻家庭方面的冲突。
Course Description
The course to be taught in the form of sub-topics, into law, sociology, ethics, psychology and other knowledge，enable students to understand the world there is a common problem in marriage and family, including the fact that marriage, non-marital cohabitation, a spouse living together with others to bring new problems marriage legislation，Homosexuality and same-sex marriage on the country’s new challenges traditional marriage and family，Countries in the prohibition and elimination of domestic violence efforts, pre-marital examination system reform and the embarrassment suffered in practice, ineffective institution of marriage changes in legislation, third party, paternity testing and surrogacy ethical issues such as marriage and family,also includes China’s Supreme People’s Court’s judicial interpretation of the Marriage Law was renamed heat problems caused by real estate, pre-marital property, common property of husband and wife after marriage the introduction of the relevant provisions of the background, the essence of legislative interpretation, etc., analysis in today’s escalating divorce rate, marriage What new home in the end facing the problem?
