课程介绍	司法制度学课程中文简介课程内容：司法制度是司法体制在宪法和法律中的具体化和制度化，属于一个国家的基本政治制度。本课程研究的是广义上的司法制度，涵盖了国家司法机关和法律授权的社会组织适用法律处理诉讼案件和非讼事务的制度，包括审判制度、检察制度、侦查制度和执行制度等基本司法制度，以及律师制度、公证制度、仲裁制度、调解制度和司法鉴定制度等相关司法制度。本课程通过介绍现代司法制度的基本原理、制度设计、基本构成，运作方式，以及相关的法律职业、法律程序等，揭示司法在现代法治社会中的地位、意义和功能。在体例设置上，本课程注重将基本原理与现实相结合，把比较各国现实的制度与介绍我国的现行制度相结合，将了解现实与探讨改革的方向相结合，以促进学生对司法体制现实和改革的思考。《司法制度学》的教学内容主要包括：第一编：司法制度学基础。简要介绍司法的历史发展与现代司法制度的建立、当代世界主要司法体制以及法律职业与法律教育。第二编：内地司法基本制度。介绍内地审判、检察、侦查以及刑罚执行制度。第三编：内地司法相关制度。介绍律师律师、法律援助制度、非诉讼纠纷解决制度和司法协助制度。第四编：港澳台司法制度。分别介绍港澳台三地的司法体制和司法制度特点。第五编：国外司法制度。重点介绍英美法德日俄等代表国以及欧盟地区司法制度的内容和特点。第六编：司法改革。在介绍司法制度的基础上探讨司法改革的方向和疑难问题。教学方式：以老师讲授为主，学生讨论为辅，借助多媒体教学设备，兼采案例教学法，体现本课程的实用性和趣味性。适合对象：就专业而言，本课程无疑可以促进法学专业的学生深入学习各门专业课程，助其思考择业方向，同时也因本课程内容的现实性和实用性，对非法学专业的学生起到极好的普法作用，增强其公民意识和法律意识；就生源地缘背景而言，因课程内容兼及境内外的司法制度及其比较，适合内外招学生；但就学生的学习基础而言，本课程适合法学专业一年级以上以及非法学专业二年级以上的学生。 Course Description This lecture is designed not only for the law students but also for them who are majored in other fields, because it is important for a qualified citizen to know the judicial system.It is basically composed of two parts: Chinese judicial system and foreign judicial system. In the first part it focuses on the judicial system in inland which is further divided into two parts: elemental judicial system, such as justice system, prosecution system, investigation system and executive system and so on； and the other relative judicial system, such as lawyer system, notarial system, arbitration system, mediation system and judicial expertise system. Then it will give a brief introduction to the judicial system in Hong Kong, Macaw and Taiwan.In the second part of this lecture it focuses on the foreign judicial system. The typical judicial systems in UK, US, France, Germany, Japan, Russia and EU will be introduced in this part.In the end, a comparative study between the Chinese and the foreign judicial system will help the students to discuss the reform of the Chinese judicial system.
